They see legal disputes as an opportunity to plead their case to judges they believe are more sympathetic than California’s legislators — especially judges at the federal level. But he allowed the district to notify parents if children ask to change their school records. The current legal dispute is not the test case that conservatives might have wished for, because it is a matter of state, not federal, law. But one of the California notification policies may eventually be contested in a federal venue, said Erwin Chemerinsky, an expert in constitutional law and the dean of the law school at the University of California, Berkeley. But, in his view, asking to be treated as a different gender doesn’t directly involve physical safety, while sharing that information without a child’s consent could put the child at risk.

Once she is sworn in, Butler will be the only Black woman in the Senate and the first openly LGBTQ+ California senator. That, alongside her background in the labor and women's rights movements, helps harden Newsom’s ties to important national Democratic constituencies. She is expected to be sworn in Tuesday in Washington by Harris, the last Black woman to serve in the Senate. At the time, Newsom was under pressure to select a Black woman to fill the seat of Harris, who is Black. His choice of Padilla, the state’s first Latino senator, rankled Black leadership in the state who saw the seat as their own.

Gavin Newsom of California vetoed a bill on Friday that would instruct judges presiding over custody battles in the state to take into consideration a parent’s support for a child’s gender identity when making custody and visitation decisions. Why It Matters: The veto signals a break from the governor’s stance in support of transgender rights. The governor added that under existing state law, the court is required to consider a child’s health, safety and welfare in these proceedings, which he said already includes the parent’s affirmation of the child’s gender identity. Background: The child custody bill passed along party lines this month. A two-thirds vote in both chambers, where Democrats hold supermajorities, could override Mr. Newsom’s veto.

SANTA ANA, Calif. (AP) — A judge on Wednesday halted a Southern California school district from requiring parents to be notified if their children change their gender identification or pronouns at school. Bonta argues the policy will forcibly out transgender students in violation of their privacy rights and threaten their well-being. Chino Valley contends the policy seeks to involve parents so they can provide support their children need. He also questioned whether elementary school students as young as 4 and 5 years old should be treated the same as high school teens involved in confidential counseling. He then worked with school board members and the California Family Council to draft the policy that was voted on in Chino Valley.

The California bill would make gender affirmation one factor among many that courts already have to consider in custody proceedings, including whether a parent has been abusive and how much contact the child has with the parents. The bill would not require judges to prioritize whether a parent affirms their child's gender identity over other factors. The state Senate passed the resolution, and it now heads to the Assembly. State Sen. Shannon Grove, a Republican from Bakersfield, said she didn’t think other states would agree to that. The bipartisan California bill would not legalize the sale of the drugs.
